Trade and cross-border services

We advise and represent your company established in Austria in preparation to access to the market and running performance of commercial and trade activities.

Our services include, inter alia,

• assessment of the legal qualifications/registrations necessary for a commercial or trade activity, performance of a contract or a certain project in Austria,
• assessment of the variety of services legally possible with a certain qualification/registration and the additional, „attached“ services attributable to other trades that may be performed with this qualification/registration without another registration,
• registration of a trade or service,
• proceedings for official recognition of individual qualifications,
• appointment of a qualified trade manager or authorized agent,
• advise on trades performed on an industrial scale,
• registration of a company in the Austrian Trade Union’s system,
• advise and representation referring to trade or industrial sites.

If your company is located in a so-called third country, i.e. a country outside the European Union, or in another member state of the European Union/European Economic Area and plans to expand to the Austrian market, you should primarily explore the specific legal settings and regulatory framework for professional commercial/trade activities in order to avoid (in parts: severe) fines and regulatory measures, pertaining up to the total prohibition of commercial/trade activity in Austria.

We will gladly conduct your access to the Austrian market. Preventively, i.e. in order to avoid fines and other sanctions, we assist you in taking the relevant precautions, e.g.

• check the legally required qualifications and notifications,
• care for the prior authorization or nostrification of qualifications, certificates and other proofs of commercial/trade activities in other EU/EER member states,
• initiate and conduct proceedings to assess equivalence of your trade registrations/qualifications in another member state of the EU or EER with the necessary qualification in Austria,
• proceedings to determine your individual qualifications for trade registration in Austria,
• registration of a trade or other commercial or professional activity in Austria,
• notification of trade or other commercial or professional activity into the public services register at the Austrian Ministry of Economy,
• appointment of trade managers or so-called authorized agents,
• establishment of subsidiaries in Austria,
• acquisition of the requisite residence permits, e.g. red-white-red card for self-employed individuals.

If the public authorities have already initiated investigations or fined your company e.g. for commercial activities without prior registration, or initiated proceedings to prohibit your company‘s activities, we will comprehensively advise and represent you, e.g. by

• intervention at the commercial and investigating authorities,
• composing the requested statements and submissions in the pending proceedings,
• legal remedies against decisions/orders (complaints, appeals),
• efficient representation in ongoing proceedings at the first instance and into proceedings following an appeal.

Our goal is to effectively plead for the suspension or the penalty proceedings, induce a reduction of the fines or induce the annulment of a prohibition of commercial activities.
